Terms of Use — Section 1: General

This document governs the access and use of "Services and Utilities" provided by "Pykatellar", including Pykatellar Company Limited (Pykatellar Co., Ltd), brand Pykatellar, root domain pykatellar.com, and subdomains listed in Section 8. "User" agrees to comply with the following terms when using any service or utility provided by "Pykatellar".

1. General Terms

1.1 Scope of Application
These terms apply to all Services and Utilities, tools, APIs, applications, and digital resources provided or managed by Pykatellar under its domains and integrated platforms, including Section 8 (Domains and Scope).
1.2 Acceptance and Binding Effect
By accessing or using Services and Utilities, the User agrees to be bound by these terms and related sections (2–9). If not agreed, the User must discontinue use immediately.
1.3 Amendments and Updates
Pykatellar may modify or update these terms at any time to comply with legal, technical, or operational changes. Updates will be published at Policy Center and are effective as stated in Notices. Continued use after the effective date constitutes acceptance.
1.4 Structure and Hierarchy
These General Terms form the foundation for specialized sections: (2) Transactions and Payments, 3) User Accounts and Conduct, 4) Resources, Data, and Services, 5) Privacy Policy, 6) Cookies and Storage, 7) Force Majeure, 8) Domains and Scope, 9) Definitions). In case of inconsistency, specialized terms prevail within their defined scope.
1.5 Legal Capacity and Age
The User confirms legal capacity under applicable law. Minors must have valid consent from a legal guardian.
1.6 Compliance with Laws and Policies
The User agrees to comply with applicable laws, community standards, and internal policies published by Pykatellar. Illegal use, infringement of third-party rights, or actions harming system integrity are prohibited.
1.7 Service Modification and Termination
For technical, security, legal, maintenance, or operational reasons, Pykatellar may suspend, restrict, modify, or terminate services without prior notice in urgent cases. Reasonable notice will be provided when possible via Notices.
1.8 Language and Interpretation
The English version governs interpretation. If translations exist, the English text prevails in case of discrepancies. Defined terms appear in quotation marks and are detailed in Section 9 (Definitions).
1.9 Notices and Electronic Communication
Pykatellar may deliver notices via website, email, user interface, or integrated channels under Notices. The User agrees to receive electronic communications with the same legal effect as written documents where permitted by law.
1.10 Account Responsibility
The User is responsible for accurate information, account security, and all activities under their account unless proven unauthorized access not caused by the User. Details in Section 3.
1.11 Intellectual Property
All source code, designs, trademarks, content, tools, and documentation belong to Pykatellar or its licensors. Unauthorized copying, modification, distribution, or commercial exploitation is prohibited.
1.12 User-Generated Content
If the User uploads, inputs, or creates content while using Services and Utilities, the User is solely responsible for ownership, licensing, and legal compliance. Usage permissions and limitations are set out in Section 4.
1.13 System Integrity
The User must not overload, attack, interfere with, reverse-engineer, disable security, or misuse system resources. Pykatellar may apply technical and legal measures and cooperate with authorities upon detecting violations.
1.14 Disclaimer and Limitation of Liability
To the extent permitted by law, Pykatellar does not guarantee uninterrupted or error-free service, or fitness for specific purposes. Liability limitations and exclusions are detailed in Section 4.
1.15 Indemnification
The User agrees to indemnify and hold Pykatellar harmless from claims, losses, damages, or expenses (including reasonable legal fees) arising from violations of these terms or applicable laws.
1.16 Assignment
The User may not assign rights or obligations under these terms without written consent from Pykatellar. Pykatellar may assign or delegate rights during restructuring, merger, or transfer of operations.
1.17 No Waiver
Failure to enforce any provision does not constitute a waiver. Waivers are valid only if documented in writing.
1.18 Severability
If any provision is deemed invalid or unenforceable, the remaining provisions remain in full force. Adjustments should reflect original intent while complying with law.
1.19 Governing Law and Jurisdiction
These terms are governed by the laws applicable to the registered location of Pykatellar Company Limited (Pykatellar Co., Ltd). Unless otherwise agreed, disputes shall be resolved by competent courts at the principal place of business of Pykatellar Company Limited (Pykatellar Co., Ltd).
1.20 Entire Agreement
These General Terms and related sections (2–9) constitute the entire agreement regarding the use of Services and Utilities. Any prior agreements conflicting with this document are void unless expressly referenced in writing.
