Terms of Use — Section 7: Force Majeure

  1. 7.1 Definition
    Force Majeure includes events beyond reasonable control, such as natural disasters, war, terrorism, government actions, labor strikes, utility failures, cloud outages, widespread cyberattacks, and pandemics.
  2. 7.2 Consequences
    Pykatellar is not liable for delays or failures caused by Force Majeure. Obligations are suspended for the duration of the event.
  3. 7.3 Mitigation
    Pykatellar will use reasonable efforts to mitigate impacts and resume services as soon as practicable.
  4. 7.4 Notification
    Pykatellar will notify Users when feasible and provide updates through official channels.
  5. 7.5 Refunds
    If services remain unfulfilled due to Force Majeure, refunds may be issued for the unrendered portion at Pykatellar’s discretion.
  6. 7.6 Alternative Performance
    Pykatellar may provide alternative services or temporary measures during Force Majeure.
  7. 7.7 Independence
    Force Majeure under this section is independent of fault or negligence.
